1. Acceptance of Terms
Welcome to Redemptive Real Estate ("Organization," "we," or "us"). Redemptive Real Estate is a California 501(c)(3) nonprofit corporation dedicated to gathering Christian real estate leaders into community for the restoration of people and place. By accessing our website (https://redemptivere.com) or participating in any Redemptive Real Estate program, event, or service (including our annual Refine Summit, roundtable discussions, prayer calls, local meetups, online community spaces, or any related services), you ("User," "Participant," "Member," or "you") agree to be bound by the following Terms and Conditions ("Terms"). If you do not agree with these Terms, you should not use our website or services, register an account, purchase tickets, make donations, or participate in our programs. These Terms form a binding legal agreement between you and the Organization.
Redemptive Real Estate is a faith-based organization that operates from a Christian worldview. Our events, programs, and community interactions may include prayer, worship, scripture references, devotionals, and other expressions of the Christian faith. Participation in any religious activity at our events is entirely voluntary. By registering for our programs or attending our events, you acknowledge the faith-based nature of our Organization and that religious content will be present. This does not require you to hold any particular belief, but we ask that all participants engage with our community respectfully.
2. Description of Services
Redemptive Real Estate provides a range of programs and services focused on connecting Christian real estate leaders for community restoration. Our services include, but are not limited to:
- Events: Organization of real estate-focused gatherings such as the annual Refine Summit, Vision Summit retreats, quarterly conferences, and local roundtable meetups (including Church Real Estate Roundtables, Multi-Family Ministry Roundtables, and ambassador-led networking events).
- Ongoing Community Programs: Weekly prayer calls, online community spaces (including Slack channels and other digital platforms), podcast content, and regular communications including newsletters and email updates.
- Online Content: Online courses, video recordings of event sessions, and an online membership portal for community members.
- Membership Programs: Roundtable memberships, network memberships, and other tiered participation opportunities that provide access to specific programs and community resources.
- Consulting and Advisory: Consulting or advisory services offered by affiliated members or partners in connection with the Organization's mission.
These services are collectively referred to as the "Services." We reserve the right to modify or discontinue certain Services or features at any time, subject to the provisions on modifications of Terms (see Section 15 below).
3. Eligibility and User Accounts
Eligibility
Our Services are intended for individuals who are 18 years of age or older. By accessing our website, registering for an event, purchasing a ticket or membership, making a donation, or otherwise using our Services, you represent and warrant that you are at least 18 years old. If you are under the age of 18, you may not use our Services, create an account, register for events, or make any purchases or donations. Our website and Services are not directed to children under 18, and we do not knowingly allow registration or collection of personal data from individuals under 18 (see also Children’s Privacy in our Privacy Policy). If we learn that a user is under the age of 18, we will terminate their account and delete any personal information collected.
Account Registration
Users may create an online account on our website to register for events, access member dashboards, manage course enrollments, and receive updates. When creating an account, you agree to provide accurate, current, and complete information (such as your name, email, phone, company, job title, and other requested details). You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account information.
Account Usage
Each user is allowed to maintain only one account, unless expressly permitted by us (for example, if you have a separate account as a participant and as an event ambassador or sponsor). You must not impersonate anyone else or misrepresent your identity or affiliation with any person or entity. We reserve the right to suspend or terminate your account (and your access to any Services) if any information provided during the registration process or afterward is or becomes inaccurate, false, or misleading, or if you violate these Terms.
4. Payments, Ticket Purchases, and Refunds
Payment Processing
When you purchase event tickets, memberships, courses, or other paid Services through our website, you will be required to provide valid payment information. Payments are handled through third-party payment processors (such as Stripe or PayPal). You authorize us to charge your chosen payment method for the prices listed at the time of your purchase, including all applicable taxes and fees. We do not directly store full credit or debit card numbers; payment information is securely transmitted to our payment processors. (We may retain non-sensitive payment identifiers such as your name, billing address, the last four digits of a card, or transaction IDs for record-keeping.)
Confirmation
After a successful payment, you should receive a confirmation (on-screen and/or via email) detailing your purchase (event registration, ticket, or course enrollment). It is your responsibility to ensure the email address provided is correct so you can receive these confirmations and other communications. If you do not receive a confirmation or have any issues, contact us at the support contact provided below.
Refund and Cancellation Policy
Because we incur costs in organizing events and providing content, purchases of event tickets, registrations, memberships, and courses are generally non-refundable, except as specified herein or required by applicable law. However, we recognize that circumstances change, and as a nonprofit Organization committed to serving our community, we will handle refund requests with fairness and care.
- Event Cancellation by the Organization: In the unlikely case that we cancel an event entirely, or must reschedule it to a different date, we will notify ticket holders as soon as possible. If an event is canceled with no rescheduled date, or if you are unable to attend on a new rescheduled date, we will offer you a full refund of the ticket price or a credit toward a future event at your choice. Such refund covers only the amount you paid for the ticket or registration; we will not be liable for any additional costs you may have incurred (such as travel or accommodation bookings) due to the cancellation or reschedule.
- Hardship Exceptions: If you are unable to attend an event or continue a membership due to significant personal hardship (such as a medical emergency, family crisis, or financial difficulty), please contact us. We will consider refund or credit requests on a case-by-case basis. Our goal is to serve our community well, and we would rather offer grace than enforce a rigid policy when genuine need exists.
- Membership Cancellation: If you join a membership program mid-cycle, your fees will be prorated to the remaining membership period unless otherwise stated at the time of enrollment. If you wish to cancel a membership, you may do so at any time by contacting us. Cancellation will take effect at the end of your current paid period. We do not provide pro-rated refunds for the unused portion of a current membership period unless required by applicable law or approved under our hardship exception.
- Tax-Deductible Portion: For events where the ticket price exceeds the fair market value of goods and services provided (such as meals, lodging, or materials), the excess amount may be tax-deductible as a charitable contribution. Refunds of ticket prices will be calculated based on the full amount paid, regardless of the tax-deductible characterization. We will provide documentation specifying the deductible and non-deductible portions of your payment as required by IRS regulations.
- Transfers: Tickets or registrations are generally personal to the participant and may not be freely transferred to another person without our approval. If you wish to transfer your ticket to someone else, please contact us. We may allow transfers on a case-by-case basis, subject to any administrative fee or new participant information needed.
- Chargebacks and Payment Disputes: You agree to contact us to attempt to resolve any billing issues or disputes before initiating a chargeback with your bank or credit card provider. We reserve the right to contest any unjustified chargebacks and to terminate your account or restrict you from future Services if you engage in fraudulent payment behavior.
5. Donations and Charitable Contributions
As a 501(c)(3) nonprofit corporation, Redemptive Real Estate accepts tax-deductible donations in support of our mission. The following terms apply to all donations:
- Tax-Deductible Status: Donations to Redemptive Real Estate are tax-deductible to the extent permitted by law. Our federal tax identification number (EIN) will be provided on all donation receipts. We will provide written acknowledgment for any single donation of $250 or more, as required by the IRS. For any payment exceeding $75 where goods or services are provided in return (a "quid pro quo contribution"), we will provide a written statement informing you of the estimated fair market value of the goods or services and the amount of your payment that is deductible.
- Use of Donations: Unless you designate a donation for a specific purpose (a "restricted gift"), all donations are considered unrestricted and may be used by the Organization for general operating purposes in furtherance of our charitable mission. If you wish to restrict your donation to a specific program or initiative, please indicate that at the time of your gift. We will make reasonable efforts to honor donor restrictions, but if a restricted purpose becomes impracticable or is fulfilled, we reserve the right to redirect the funds to a similar purpose consistent with our mission, with notice to the donor where practical.
- Donation Refunds: Donations are generally non-refundable. If you believe a donation was made in error (for example, a duplicate charge or incorrect amount), please contact us within 30 days of the transaction and we will work with you to resolve the issue. Refunds of donations will be processed at our discretion and may affect the tax-deductible status of the original contribution.
- Donor Privacy: We treat all donor information as confidential. Donation amounts, giving history, and donor identity will not be shared with sponsors, partners, or any third party except as required by law or with service providers who process donations on our behalf. See our Privacy Policy for full details on how we handle donor data. If you wish to make an anonymous donation, please let us know at the time of your gift.
- No Goods or Services: Unless specifically disclosed (such as when an event ticket includes a charitable contribution component), donations to Redemptive Real Estate do not entitle you to receive any goods, services, membership benefits, or event access in return. Where a payment includes both a purchase component and a donation component, we will clearly disclose each portion.
6. Participant Conduct and Community Guidelines
We are committed to providing a safe, respectful, and Christ-honoring environment at our events and within our community. By participating in our events, online community spaces, or any other program, you agree to the following conduct guidelines:
- Respect and Professionalism: Treat all staff, speakers, sponsors, fellow participants, and venue personnel with courtesy and respect. Harassment, discrimination, or abusive behavior (whether verbal, physical, or written) will not be tolerated. This applies during scheduled event sessions, networking breaks, prayer calls, online community interactions (including Slack channels), and any related activities.
- Compliance with Venue Rules and Law: Follow all instructions from event organizers and venue rules. You must also comply with all applicable laws and regulations while participating in our events or using our site. Any illegal activity or behavior that jeopardizes the safety of others is strictly prohibited.
- No Disruption: Do not substantially disrupt talks, workshops, prayer calls, roundtable discussions, or other activities. Maintain decorum during sessions (for example, silencing phones and not causing interruptions). We encourage enthusiastic participation, but it must not impede the experience of others.
- Alcohol and Substances: If alcohol is served or available at an event, please consume responsibly. We reserve the right to limit or cut off alcohol service to any participant at our discretion. The possession or use of illegal drugs at any of our events is strictly forbidden.
- Ambassadors and Representatives: If you are an official ambassador or acting in any representative capacity for Redemptive Real Estate, you are expected to uphold these same standards and also adhere to any additional guidelines provided for representatives.
- Enforcement: We reserve the right to refuse admittance to, or remove any participant from, any event (or restrict a user from online communities) if they violate these conduct rules or otherwise pose a risk to others. If you are removed from an event for misconduct, you will not receive a refund of any fees paid, and you may be restricted from attending future events or using our Services. We also reserve the right to terminate or suspend your user account for violations of these conduct standards or any other provisions of these Terms.
7. Intellectual Property and Content Usage
All content provided through our Services — including our website content, event presentations, course materials, videos, written articles, logos, graphics, and trademarks — is the intellectual property of Redemptive Real Estate or of our licensors, speakers, or partners. This content is protected by copyright, trademark, and other intellectual property laws.
Our License to You
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the content on our website and at our events for your personal, informational, and non-commercial use only. For example, you may watch streaming videos or download course PDFs for your own learning.
Restrictions
You may not copy, reproduce, distribute, modify, or create derivative works from any of our content without our express written permission. Recording event sessions (video or audio) or taking detailed transcripts for distribution is prohibited unless explicitly allowed by us. Similarly, you may not use any of our trademarks (including our name Redemptive Real Estate) without permission, except as allowed by fair use law.
Speaker and Presenter Content
Speakers, presenters, and contributors at Redemptive Real Estate events retain ownership of their original content and intellectual property. By presenting at a Redemptive Real Estate event, speakers grant the Organization a non-exclusive, worldwide, royalty-free license to record, reproduce, distribute, and display their presentation (in whole or in part) for educational, promotional, and archival purposes in connection with our mission. Speakers who wish to limit or modify this license must do so in writing via a separate speaker agreement prior to the event. If you are a speaker and have questions about content usage, please contact us before your presentation.
Participant Contributions
If certain features allow you to post or submit content (for example, commenting on forums, participating in group discussions, or sharing testimonials), you retain ownership of the content you create, but by posting it, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display that content as needed for operation of the Service or promotional purposes. You must ensure that any content you post does not infringe the rights of any third party and is not unlawful or inappropriate. We reserve the right to remove user-posted content that violates these Terms or our guidelines.
Any unauthorized use of our intellectual property or that of our speakers and partners may result in termination of the license granted to you and possibly legal action. If you wish to use any of our content beyond what is permitted by these Terms, please contact us for permission.
8. Photography, Media, and Recordings
Redemptive Real Estate may photograph or record our events (video and/or audio) for promotional, educational, and archival purposes. We distinguish between two types of media capture, consistent with our Privacy Policy:
General Event Photography: At large gatherings such as the Refine Summit, we may capture crowd shots, venue images, and general event photography. We will post visible signage informing participants that photography and videography are taking place. If you prefer not to be photographed, please inform our event staff and we will make reasonable efforts to honor your request.
Session and Content Recordings: For roundtable discussions, prayer calls, workshops, or any session where participants may share personal testimony, faith reflections, or sensitive professional information, we will obtain your explicit written consent before recording. A media release form will be provided at registration or at the start of the session. You may decline to be recorded without affecting your ability to participate in the session. We will never publish or distribute a recording that features your personal testimony or identifiable remarks without your prior written approval.
By attending an event where general photography is occurring and signage is posted, you acknowledge that incidental images of you may be captured. For any use beyond general event documentation, we will seek your specific consent. If you discover that your image or voice has been used in any Redemptive Real Estate material and you did not consent, please contact us immediately and we will remove it.
9. Third-Party Websites, Services, and Interactions
External Links
Our website and event materials may include links to third-party websites or resources (for example, sponsor websites, partner services, or articles of interest). We provide these links solely for convenience and reference. We do not control, endorse, or assume any responsibility for any third-party sites or content. If you access external links, you do so at your own risk. We recommend you review the terms and privacy policies of any third-party sites you visit. Redemptive Real Estate will not be liable for any loss or damage that may arise from your use of third-party websites or resources.
Dealings with Sponsors, Partners, and Fellow Participants
At our events or through our community, you may have opportunities to engage with sponsors, exhibitors, other participants, or partners. Any dealings, commercial transactions, or legal relationships between you and a third party (such as a sponsor, exhibitor, or fellow participant) are solely between you and that third party. Redemptive Real Estate is not a party to any agreements you enter with sponsors, other participants, or any other person or entity (including, without limitation, investment deals, joint ventures, partnerships, consulting arrangements, or real estate transactions that might arise from networking at our events or through our community).
To be clear: Redemptive Real Estate does not broker, arrange, endorse, guarantee, or facilitate any specific business transaction, real estate deal, investment opportunity, or commercial arrangement between participants, members, sponsors, or any other parties. While our mission includes connecting mission-aligned leaders, the Organization's purpose is educational and community-building, not transactional. Any business relationship you enter into with someone you meet through Redemptive Real Estate is entered into at your own risk, based on your own independent evaluation and due diligence. We make no representation regarding the financial condition, business practices, integrity, or qualifications of any participant, sponsor, speaker, or partner. You are solely responsible for conducting your own due diligence before entering into any business arrangement.
We strongly encourage you to consult with qualified legal, financial, and tax professionals before making any investment or business decision. Redemptive Real Estate shall have no liability for any losses, damages, or disputes arising from any transaction or relationship between you and any third party, regardless of whether the introduction was made through our programs.
Third-Party Platforms
We may use third-party platforms or services as part of our Services (for example, Slack for community discussions, third-party event apps, or streaming services for virtual sessions). Your use of those platforms may be subject to the third party's terms of service. We are not responsible for acts or omissions of third-party platform providers. However, if you encounter an issue with a third-party service integrated into our offering, you can report it to us and we will attempt to assist or address it within the scope of our own Service.
10. Membership Terms
Redemptive Real Estate offers membership programs (including roundtable memberships, network memberships, and other tiered programs) that provide access to specific benefits, programs, and community resources. The following terms apply to all membership programs:
- Membership Period and Renewal: Memberships are offered on an annual basis unless otherwise stated at the time of enrollment. Your membership begins on the date your payment is processed and continues for the stated membership period. We will notify you in advance of your membership renewal date. Unless you cancel before the renewal date, your membership may be renewed automatically (if you have authorized recurring payments) or you will be prompted to renew manually. We will not charge your payment method for renewal without prior notice and, where applicable, your continued authorization.
- Membership Benefits: Specific benefits included with each membership tier will be described at the time of enrollment. Benefits may include event access, roundtable participation, community access, content access, and other program-specific features. We reserve the right to modify membership benefits from time to time, but will provide reasonable notice of material changes and will honor the core benefits of your current membership period through its expiration.
- Membership Conduct: As a member, you are expected to adhere to the participant conduct guidelines in Section 6 across all membership interactions, including online community spaces (such as Slack channels), roundtable discussions, prayer calls, and any other member-only programming. Membership is a privilege of community participation, not merely a commercial subscription.
- Revocation: We reserve the right to revoke or suspend a membership if a member violates these Terms, the participant conduct guidelines, or engages in behavior that is harmful to the community or inconsistent with our mission and values. If we revoke a membership for cause, we are not obligated to provide a refund for any unused portion of the membership period. Before revoking a membership, we will make reasonable efforts to address the issue with the member directly, consistent with our commitment to relational resolution.
- Membership Termination: You may cancel your membership at any time by contacting us. Cancellation will take effect at the end of your current paid membership period. Upon cancellation, you will lose access to member-only benefits and community spaces. Your account and any non-member content or features will remain available to you.
11. SMS and Text Messaging
By providing your mobile phone number and opting in to receive text messages from Redemptive Real Estate (whether during event registration, membership enrollment, community sign-up, or through any other opt-in mechanism), you consent to receive text messages from us at the phone number you provide. Messages may include event reminders, prayer call notifications, roundtable updates, community announcements, and other communications related to our Services.
- Message Frequency: Message frequency varies based on your level of participation and the programs you are enrolled in. During active event periods, you may receive multiple messages per week. At other times, message frequency may be lower.
- Message and Data Rates: Standard message and data rates from your wireless carrier may apply. Redemptive Real Estate does not charge a fee for sending text messages, but your carrier's standard messaging rates will apply.
- Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message you receive from us, or by contacting us at [email protected]. After opting out, you will receive a final confirmation message and will no longer receive text messages from us unless you opt in again. Opting out of text messages will not affect your membership, event registration, or any other aspect of your participation in our programs.
- Consent Not Required for Participation: Your consent to receive text messages is not a condition of purchasing any goods or services, attending any event, or participating in any program offered by Redemptive Real Estate. You may decline to provide your mobile number or decline to opt in to text messages without any impact on your ability to participate.
- Privacy: We will not share your mobile phone number with third parties for their marketing purposes. Your phone number will be used only for the purposes described in this section and as described in our Privacy Policy. For questions about our SMS practices, contact [email protected].

No Guarantees of Outcome
Redemptive Real Estate provides opportunities for education, community-building, spiritual formation, and networking, but we do not guarantee any particular outcomes or success. We make no promise that attending an event or course will result in obtaining financing, closing real estate deals, achieving investment returns, or any specific business results. Any testimonials or case studies presented are for illustrative purposes only and do not represent typical or guaranteed outcomes. You acknowledge that results depend on many factors outside our control, including your own efforts and market conditions.
No Professional Advice
The content and information presented through our Services (including event presentations, workshops, online courses, and any materials provided) are for informational and educational purposes only. Neither the Organization nor any speakers, instructors, or contributors are providing legal, financial, investment, tax, or other professional advice specific to your situation. Redemptive Real Estate is not a licensed investment advisor, broker, law firm, or financial planner. While real estate, business, or investment strategies may be discussed at our events and in our community, you should always consult with a qualified professional before making any decisions based on such information. Nothing obtained from Redemptive Real Estate events, materials, or community interactions should be considered a substitute for individualized professional advice.
No Endorsement of Transactions
Redemptive Real Estate does not endorse, recommend, or guarantee any investment opportunity, real estate transaction, business arrangement, or financial product discussed at our events or within our community. The fact that a transaction, deal, or opportunity is discussed at a Redemptive Real Estate event or by a member of our community does not constitute the Organization's endorsement or approval. Use at Your Own Risk
You agree that your use of the Services and any information obtained through them is at your sole risk. The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied. This includes, but is not limited to: implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services (or any content therein) are accurate, complete, reliable, current, or error-free. We also do not guarantee that the website or event venues will be secure, or free of viruses or other harmful components, though we strive to maintain security.
Event-Specific Disclaimers
By participating in in-person events, you acknowledge that there are inherent risks (such as minor injuries, illness, or other unforeseen incidents) that can occur at any large gathering. We will take reasonable measures for participant safety, but we cannot eliminate all risk. You agree that you are personally responsible for your own safety and well-being during events. We encourage participants to be mindful of their belongings; we are not responsible for lost, stolen, or damaged personal items at events. If you have a medical condition or require special accommodations, please inform us in advance and we will attempt to accommodate as reasonably possible, but we make no guarantee of any specific accommodation beyond what is required by law.
Technology and Availability
For online aspects of our Services (such as streaming video sessions or course access), we disclaim liability for any technical issues or interruptions. We do not guarantee that the online Services will be available at all times or without delay, interruption, or error. Technical support will be provided in reasonable capacity, but you are responsible for ensuring you have the necessary devices, internet connection, and software to access our online Services.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Redemptive Real Estate and its affiliates, officers, directors, employees, agents, partners, speakers, and sponsors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the Services or participation in events. This includes, without limitation, damages for lost profits, lost opportunities, business interruption, goodwill, data loss, or other intangible losses, even if we have been advised of the possibility of such damages.
In particular, we will not be liable for:
- Personal Injuries or Property Damage: Any personal injury, illness, or property damage that may occur at event venues, except to the extent caused directly by our gross negligence or intentional misconduct. You participate in events at your own risk and are expected to behave responsibly (see Section 6: Participant Conduct).
- Third-Party Acts: Any acts or omissions of third parties, including other participants, sponsors, speakers, or vendors at our events. We are not liable for disputes or damages arising from interactions you have with other individuals or organizations at or through our events.
- Decisions and Outcomes: Any decisions you make or outcomes you experience based on information gained through our Services. This includes any investment, real estate, or business decisions; you are solely responsible for researching and evaluating any opportunities and we shall not be liable for the results of your decisions.
If, notwithstanding the above disclaimers and limitations, Redemptive Real Estate is found liable for any claim arising out of or related to these Terms or the Services, our aggregate liability to you for all claims (for damages or losses of any kind) shall not exceed the total amount you have paid us in the past twelve (12) months (if any) for the Service at issue, or, if greater, $100 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Redemptive Real Estate, its affiliates, and their respective officers, directors, employees, agents, and partners (including event sponsors and hosts) from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your breach of any provision of these Terms; (b) your violation of any law or regulation or the rights of any third party; or (c) your use of the Services or participation in events, including any content you submit or acts you take in reliance on information obtained through us. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim). This indemnity obligation will survive the termination or expiration of your agreement with us.
15. Changes to Terms
We may modify or update these Terms and Conditions from time to time to reflect changes in our Services, legal obligations, or for other operational reasons. If we make material changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date at the bottom, or by email notification to registered users, if appropriate. Continued use of the Services or participation in programs after any modifications to the Terms constitutes acceptance of those changes. It is your responsibility to review these Terms periodically. If you do not agree to any updated terms, you must stop using the Services and (if applicable) may cancel your account or memberships subject to our refund and cancellation policies.
16. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles.
Mediation and Resolution
Consistent with our values as a faith-based community, we believe that disputes are best resolved through direct communication and, where necessary, mediated conversation. If you have a dispute with Redemptive Real Estate, we ask that you first contact us directly so we can attempt to resolve the matter informally. If informal resolution is not successful within thirty (30) days, either party may submit the dispute to mediation administered by a mutually agreed-upon mediator in Santa Barbara County, California. Each party shall bear its own costs for mediation, and the parties shall share equally in the fees of the mediator.
Arbitration
If mediation does not resolve the dispute within sixty (60) days of the mediator's appointment (or such longer period as the parties may agree), either party may submit the dispute to binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Santa Barbara County, California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in the courts identified below.
Court Jurisdiction
For any disputes not subject to arbitration, or if the arbitration provision is found unenforceable, you agree that such disputes shall be exclusively brought in the state or federal courts located in Santa Barbara County, California, and you consent to the personal jurisdiction of such courts. Notwithstanding the foregoing, we reserve the right to seek injunctive or equitable relief in any jurisdiction to protect our intellectual property or enforce our rights.
17. Force Majeure
Redemptive Real Estate shall not be liable for any failure or delay in performing our obligations under these Terms (including the hosting of events or delivery of Services) to the extent that such failure or delay results from circumstances beyond our reasonable control. Such circumstances include, but are not limited to: natural disasters (earthquakes, floods, hurricanes, wildfires), pandemics or epidemics, government orders or restrictions, acts of terrorism, war, labor disputes, utility or telecommunications failures, venue unavailability due to circumstances beyond our control, or any other events commonly recognized as force majeure.
In the event of a force majeure occurrence that prevents us from holding a scheduled event, we will notify registered participants as soon as reasonably practicable and will offer either a rescheduled date, a credit toward a future event, or a refund of registration fees, at the Organization's discretion. We will not be liable for any incidental costs (such as travel, accommodation, or lost business opportunities) incurred by participants as a result of a force majeure cancellation or postponement.
18. Accessibility
Redemptive Real Estate is committed to ensuring that our events and digital Services are accessible to individuals with disabilities. We select event venues that comply with applicable accessibility requirements under the Americans with Disabilities Act (ADA) and other relevant laws. 19. Miscellaneous
- Entire Agreement: These Terms (along with any event-specific rules or ticket terms, our Privacy Policy, and any membership agreement you may enter into) constitute the entire agreement between you and Redemptive Real Estate regarding the use of our Services, and supersede any prior agreements or understandings (whether written or oral).
- No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Organization.
- Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
- Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, reorganization, or transfer of operations, or by operation of law or otherwise. These Terms shall inure to the benefit of and be binding upon the parties and their permitted assigns.
- Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.
